Tennessee football: Vols WR Josh Smith’s roommate may end up seeking $3 million in damages

Tennessee football wide receiver Josh Smith has more legal issues. The Volunteers senior’s roommate is now seeking payment for damages.

Tennessee football’s Josh Smith could be facing a multi-million dollar lawsuit from his roommate in the near future.

The Vols senior’s roommate threatened him with a $3 million civil lawsuit if he and his family don’t pay $875,000 in damages by Memorial Day, according to a report on WNML radio.

Smith was arrested earlier this month on a domestic assault charge against his roommate.

Here is a snippet of the new report.

"Kennedy Foster, a childhood friend of Smith’s, suffered a broken nose, broken teeth, and damage to his eyes and right ear, according to claims by his attorney, George Underwood Jr."

However, Keith Stewart, the Smith family attorney, is suggesting that it looks like extortion. Here’s a quote from him in the story.

"“I’m not accusing him (Foster) of extortion, but that’s what it looks like. Given my understanding that Mr. Foster’s attempts to press charges against Malcolm Stokes were unsuccessful, it seems his motives are clear.’’"

Stokes was apparently involved in the incident that caused the arrest, which included a fight among him, Smith, and Foster.

The arrest happened the first weekend in May. Here is a snippet of the original report according to the Knoxville News Sentinel that we printed when it happened.

"In the report, Smith stated that he and Foster had started drinking around 10 p.m. Friday and admitted to kicking down the door out of concern for Foster’s well-being. Smith claimed in the report that he was then tackled by Foster and a fight between the two began. According to the report, Smith claims to have left the room afterward."

Regardless of how this turns out, and there’s a very strong possibility that Smith is innocent, we mentioned at the time that this is terrible timing for him.

He already missed the spring due to injury, and other slot receivers really stepped up during that time.

So he needed a great August and no distractions to hold onto his job. That could be in jeopardy now, but only time will tell.

At this point, he probably just wants to focus on putting this incident behind him.
